State Farm faces a potential class action lawsuit over denied claims

State Farm is reportedly facing a potential class action lawsuit over its denied water damage claims, according to a CBS 8 report.

The news station interviewed attorney Eric Jenkins, who is in the early stages of suing State Farm through a class action. If it goes ahead, the lawsuit will focus on water damage claims that were denied because of relatively new policy language that one adjuster general suggested was riddled with ambiguity.

“In 2019, (State Farm) came out with an updated policy that was very vague,” David Melzer, president and CEO of Property Claims Consultant, told CBS 8.

As stated, the insurer’s revised policy used language excluding coverage for ongoing water leaks that occur or develop “over a period of time.”

“Most other insurance policies specifically state that a leak continues for 14 days or more, but State Farm’s policy is now just ‘any persistent leak, whatever that is,'” Melzer told the news station.

“It’s a very vague statement in their policy, and they’re using that to completely deny claims,” Jenkins added.

When contacted by CBS 8, State Farm issued this response: “Due to our customer privacy policy, we cannot speak to the details of the claim.

“While we empathize with our customers when they experience a loss, it is important to note that every claim is unique and not all losses are covered by insurance. Our commitment to pay what we owe has not changed.”
